By downloading or using the UpDate app ("the App") or using the UpDate website, you agree to these Terms of Use. Please read them carefully. If you do not agree to these Terms, do not use the App or website.

The App

UpDate is a personal dating reflection and analysis tool that helps you examine yourself, set standards, and analyze your dating patterns. It is not a dating app and does not match or connect you with other users. All AI-generated content is for personal guidance only and should not be treated as professional relationship, psychological, legal, medical, or financial advice.

Eligibility

You must be at least 18 years old to use UpDate. By using the App or website, you represent and warrant that you are at least 18 years of age. If we become aware that a user is under 18, we will terminate their account and delete their data.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to keep it up to date. You must notify us immediately of any unauthorized access to or use of your account.

Purchase and Payment

UpDate is offered as a one-time purchase through two channels:

• Apple App Store: Payments are processed by Apple in accordance with Apple's terms. Refunds are governed by Apple's refund policy and are requested directly through Apple.
• Our website (outsmartyourheart.com): Payments are processed by Stripe. We do not store your payment card details. Refund requests for web purchases should be emailed to support@outsmartyourheart.com within 14 days of purchase; we will evaluate refund requests in good faith and are not obligated to grant refunds except as required by applicable law.

Prices may change. Price changes will not affect purchases already completed. We reserve the right to modify the scope of features included in your purchase; if we do so in a way that materially reduces what you paid for, we will offer a pro-rata refund.

Acceptable Use

You agree to use UpDate only for personal, non-commercial purposes. You agree not to:

• Use the App or website to harass, stalk, or harm any person
• Attempt to reverse engineer, copy, modify, distribute, or create derivative works of the App
• Use the App or website in any way that violates applicable laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated means (bots, scrapers) to access the App or website
• Resell, sublicense, or commercially exploit the App or website
• Use the App or website to generate content about identifiable third parties in a manner that violates their privacy or reputation

Your Content

All data you enter into the App — including your self-profile, standards, ratings, and notes — belongs to you. We do not claim ownership of your content. You grant us a limited, non-exclusive license to store, process, and transmit your content solely to provide the App's features (including transmission to our AI processing provider as described in our Privacy Policy).

You are responsible for the accuracy and legality of the content you enter. When you rate or enter information about other people (for example, people you are dating), you are responsible for complying with applicable laws regarding third-party information.

AI-Generated Content

The App uses AI to generate personalized strategies, analyses, and profile content. This content is generated based on the information you provide and is intended as a personal tool only. It does not constitute professional relationship, psychological, legal, medical, or life advice. We make no guarantees about the accuracy, completeness, or usefulness of AI-generated content. You are solely responsible for any decisions you make based on AI-generated output.

AI-generated content may contain errors, omissions, or outputs that do not reflect your actual situation. Do not rely on AI-generated content for decisions with significant legal, medical, or financial consequences.

Termination

You may terminate your account at any time by using the in-app account deletion feature or by contacting us at support@outsmartyourheart.com.

We may suspend or terminate your access to the App or website if we reasonably believe you have violated these Terms, engaged in fraudulent or illegal activity, or created risk or legal exposure for us. If we terminate your access for a material violation, no refund will be issued. If we terminate your access without cause, we will refund a pro-rata portion of your purchase price where legally required.

Privacy

Your use of the App and website is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Disclaimers

THE APP AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR PRODUCE ANY PARTICULAR OUTCOMES IN YOUR DATING LIFE OR RELATIONSHIPS.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, UPDATE AND ITS OWNERS, OPERATORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO RELATIONSHIP OUTCOMES, EMOTIONAL DISTRESS, LOST PROFITS, OR DECISIONS MADE BASED ON APP OR WEBSITE CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE APP OR WEBSITE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless UpDate and its owners from any claims, damages, or expenses arising from your use of the App or website, your violation of these Terms, or your violation of any third-party rights.

Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the date at the top of this page and, for material changes, by in-app notification or email. Continued use of the App or website after changes constitutes acceptance of the updated Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the App or website shall be resolved exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.

If you are a consumer located in the European Union, United Kingdom, or another jurisdiction that grants you mandatory rights to bring claims in your local courts, this section does not override those rights.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and UpDate regarding your use of the App and website, and supersede any prior agreements.
